These Terms and Conditions of Use (“Terms”) are a contract between you and Swap. They govern your access to and use of the Swap mobile application, website, and related services (collectively, the “App”). By creating an account, accessing, or using the App, you agree to be legally bound by these Terms, our Privacy Policy, and our Community Guidelines, each incorporated by reference.

If you do not agree, do not use the App.


1) ELIGIBILITY AND ACCOUNT REGISTRATION

1.1 Minimum age. You must be 18+ or the age of legal majority where you reside, whichever is higher.

1.2 Legal use. You must be legally permitted to use the App in your country.

1.3 Single account. You must not create or use more than one account without our written permission.

1.4 Registration methods. You may register with an email/phone or supported single sign-on providers. You authorize us to collect and use account data as described in the Privacy Policy.

1.5 Identity verification. We may require ID or phone verification anytime. Failure to complete verification may lead to feature limits, suspension, or termination.

1.6 Underage use. We monitor for underage activity and will suspend or terminate suspected underage accounts.

1.7 Account security. You are responsible for your credentials and all activity on your account. Keep your password safe and do not share your account.

1.8 Deleting your account. You can delete your account in Settings. Deletion may not immediately remove all content from backups or caches. See Section 17.


2) APP PURPOSE AND SCOPE

2.1 Marketplace facilitator. Swap provides tools for users to discover each other and swap items. We do not own, list, store, inspect, ship, or guarantee items.

2.2 No guarantees. We do not guarantee matches, successful swaps, item quality, legality, fitness, or safety of any item or user.

2.3 Local meetings. For in-person swaps, arrange public, well-lit venues and follow our safety tips. You assume all risks in interactions on and off the App.


3) COMMUNITY GUIDELINES 

3.1 Required conduct. You must follow our Community Guidelines at all times.

3.2 Prohibited areas (high-level). The following are strictly prohibited: harassment or hate; scams and fraud; promotion of illegal acts; sexual content; threats or violence; doxxing; child endangerment; CSAM/CSAE; spam; platform manipulation; and intellectual-property violations.

3.3 Enforcement. We may remove content, rate-limit features, restrict visibility, warn, suspend, or ban accounts, and notify law enforcement when required.

3.4 Off-platform conduct. Credible reports of misconduct off-platform that threatens user safety may result in action on your account.


4) CHILD SAFETY AND CSAE POLICY

4.1 Zero tolerance. Swap enforces a zero-tolerance policy toward Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM).

4.2 Prohibited conduct. You must not:

Exploit, groom, or endanger minors.

Upload, request, produce, share, or store any content that sexualizes or depicts minors, real or fictional, including anime, drawings, or AI images.

Engage in conversations or activities targeting minors.

4.3 Immediate action. We remove material, terminate accounts, preserve evidence, and may report to authorities and hotlines consistent with applicable law.

4.4 Reporting. Use the in-app Report tool or email [email protected].

4.5 App store compliance. We comply with Google Play Child Safety Standards and Age-Restricted Content and Functionality requirements.


5) ITEMS, LISTINGS, AND EXCHANGES

5.1 User responsibility. You are solely responsible for your listings, descriptions, condition, authenticity, and legality of items.

5.2 Banned items. No illegal goods, regulated weapons, drugs/controlled substances, stolen property, counterfeit goods, hazardous materials, or other items prohibited by law or our policies.

5.3 Accuracy. Listings must be accurate and not misleading. Provide clear photos and disclose defects.

5.4 No escrow. Swap does not provide escrow, shipping, insurance, or authentication. Arrange logistics directly with other users.

5.5 Risk. You assume all risks from swaps, including loss, damage, injury, or disputes.


6) CONTENT DEFINITIONS AND OWNERSHIP

6.1 Your Content. Anything you post, upload, or transmit, including text, photos, videos, messages, and metadata.

6.2 Member Content. Content posted by other users.

6.3 Our Content. The App, code, databases, text, UI, logos, trademarks, and other materials owned or licensed by Swap.

6.4 License you grant to Swap. By posting Your Content, you grant Swap a non-exclusive, worldwide, royalty-free, transferable, sub-licensable license to host, store, reproduce, adapt, publish, distribute, display, and create derivative works for operating, improving, promoting, and securing the App. This license ends when Your Content is deleted from our systems (subject to backups, caches, legal holds, and Section 17).

6.5 No IP transfer. You retain ownership of Your Content. We retain ownership of Our Content.

6.6 No scraping or reverse engineering. You may not copy, scrape, crawl, index, archive, decompile, or reverse engineer the App except as permitted by law.


7) PROHIBITED CONTENT AND BEHAVIOR

You may not post, transmit, or engage in:

a) Illegal content or solicitation of illegal acts.

b) CSAE/CSAM or sexualization of minors (Section 4).

c) Harassment, bullying, threats, or hate based on protected attributes.

d) Violence or incitement, including trafficking or exploitation.

e) Adult sexual content or solicitation for sexual services.

f) Scams, fraud, impersonation, or inauthentic profiles.

g) Misinformation likely to cause harm or undermine civic processes or public health.

h) Spam, platform manipulation, or automation without authorization.

i) Malware, spyware, or attempts to bypass security.

j) IP violations, including unauthorized use of copyrighted materials and trademarks.

k) Commercial promotions unrelated to swapping (unless in an approved feature or program).

l) Doxxing or publication of others’ personal data without consent.


8) REPORTING, MODERATION, AND ENFORCEMENT

8.1 How we moderate. We use automated systems, human moderation, and user reports to detect and address violations.

8.2 Actions we may take. Content removal; warnings; feature limits; shadow-visibility; temporary suspensions; permanent bans; device or phone verification; law-enforcement referrals.

8.3 Appeals. If your content or account is actioned, you may appeal via the App or [email protected]. Provide details and any evidence. Not all decisions are reversible.

8.4 Emergency threats. If there is an imminent threat to life or safety, contact local authorities first.


9) SAFETY AND IN-PERSON MEETINGS

9.1 Meet-up guidance. Meet in public, well-lit areas. Tell a friend. Consider daytime exchanges. Inspect items carefully.

9.2 No background checks by default. We do not conduct comprehensive background checks. Public records are incomplete and can be outdated.

9.3 Your responsibility. You assume all risks in interactions with other users on or off the App.


10) APP FEATURES AND RECOMMENDATION SYSTEMS

10.1 Discovery and matching. The App uses ranking and recommendation signals to surface items and users.

10.2 Signals. Signals may include profile completeness, listing quality, recency, location, and user interactions. We do not guarantee exposure, reach, or matches.

10.3 Changes. We may update algorithms to improve safety and relevance.


11) THIRD-PARTY SERVICES AND STORES

11.1 App stores. Your use of store-provided features is subject to their terms. App stores have no warranty or support obligations for the App.

11.2 Third-party links. We are not responsible for third-party sites, content, or services linked from the App. Access them at your own risk.

11.3 Integrations. Using third-party integrations within the App may be subject to their separate terms and privacy notices.


12) INTELLECTUAL PROPERTY COMPLAINTS 

12.1 Copyright. If you believe any content infringes your copyright, send a detailed notice to [email protected] with:

Your contact details and electronic signature.

Identification of the copyrighted work.

The exact URL or in-App location of the allegedly infringing content.

A statement of good-faith belief that use is not authorized.

A statement that the notice is accurate and you are the owner or authorized agent.

12.2 Trademarks. For trademark concerns, include jurisdiction, registration number, and evidence of rights.

12.3 Repeat infringers. We may terminate repeat infringers.


13) PRIVACY

Your information is collected and processed as described in our Privacy Policy (swapegypt.app/privacy) . By using the App, you consent to those practices, including cross-border transfers where applicable.


14) DISCLAIMERS

14.1 “As is” and “as available.” The App and all content are provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

14.2 No guarantee of outcomes. We do not guarantee item availability, matches, swap success, safety, or uninterrupted service.

14.3 User responsibility. You are solely responsible for your interactions, listings, and compliance with laws.


15) LIMITATION OF LIABILITY

To the maximum extent permitted by law, Swap and its owners, directors, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the App, whether based on contract, tort, statute, or otherwise, even if advised of the possibility of such damages.

In any case, our aggregate liability shall not exceed USD 100.

Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent permitted.


16) ACCOUNT CLOSURE, CONTENT RETENTION, AND BACKUPS

16.1 User deletion. When you delete your account, we generally remove your profile and listings from user-facing surfaces.

16.2 Retention. Copies may remain in backups, logs, caches, or legal holds for a limited period, or longer if required by law, investigations, dispute resolution, or to enforce these Terms.

16.3 Messages. Content sent to other users may persist in their accounts.

16.4 Operational data. We may retain minimal records for fraud prevention, safety, and compliance.


17) SUSPENSION AND TERMINATION BY SWAP

17.1 Grounds. We may suspend or terminate access for violations of these Terms, Community Guidelines, or the law; risks to user safety; fraud; platform abuse; or repeated IP infringements.

17.2 Effect. Termination may include loss of access to Your Content and paid features.

17.3 Appeal. You can appeal via the App or [email protected]. Decisions are discretionary.


18) CHANGES TO THE APP OR TERMS

18.1 Product changes. We may modify, suspend, or discontinue features without liability.

18.2 Terms updates. We may update these Terms. The “Effective date” will change. Continued use after updates means you accept the revised Terms.


19) COMMUNICATIONS AND NOTICES

19.1 Electronic delivery. You consent to receive notices electronically via the App, email, or website postings.

19.2 Contact. For legal notices, use [email protected] with subject “Legal Notice”.


20) GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Arab Republic of Egypt without regard to conflicts rules. Courts of Cairo, Egypt have exclusive jurisdiction over disputes not otherwise resolved. You waive any objection to venue and forum.


22) INTERNATIONAL USE; SANCTIONS

You represent that you are not located in a country subject to comprehensive sanctions and are not on any sanctions list. You agree to comply with applicable export-control and sanctions laws when using the App.


23) MISCELLANEOUS

23.1 Entire agreement. These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and Swap.

23.2 Severability. If any provision is unlawful or unenforceable, the remainder remains in effect.

23.3 No waiver. Failure to enforce a provision is not a waiver.

23.4 Assignment. You may not assign these Terms. We may assign them without restriction.

23.5 Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.

23.6 Language. The English version controls if translations differ.

ANNEX A — COMMUNITY GUIDELINES (DETAILED)

These Guidelines form part of the Terms.

A.1 Safety and Respect
Treat others with respect. No harassment, bullying, blackmail, intimidation, or body-shaming.
No hate or dehumanization based on protected attributes (race, ethnicity, nationality, immigration status, caste, sex, gender identity or expression, sexual orientation, disability, serious disease, religion/belief).
A.2 Authenticity
Use your real age and an authentic name you use in daily life.
No impersonation, catfishing, or materially false profile claims (e.g., age, location).
We may ask for ID or a selfie match to verify.

A.3 Profiles and Media

Use clear photos that represent you or your item.
No nude or sexually explicit content. No sexual fetish content.
No photos of children alone or unclothed children in any context.
A.4 Items and Listings
Accurately describe condition, authenticity, defects, and legality.
Prohibited: illegal goods, regulated weapons, controlled substances, dangerous items, counterfeit or stolen property, hazardous chemicals, sensitive surveillance devices, and items prohibited by law or store policies.
A.5 Commercial Activity
Swap is not a general marketplace for monetary sales. No unsolicited promotions or external lead-gen unless explicitly allowed.
No spam, mass messaging, or link manipulation.
A.6 Misinformation and Harm
Do not share demonstrably false or materially misleading content that may cause real-world harm, including public health or civic processes.
A.7 Violence and Exploitation
No threats, glorification of violence, or trafficking.
No facilitation of sexual services or “sugar” arrangements.
A.8 Minors and CSAE/CSAM
Strictly prohibited; see Section 4.
When in doubt, report.
A.9 Platform Integrity
No scraping, scripting, or automated actions.
No ban evasion, device evasion, or selling accounts.
A.10 Reporting and Appeals
Use in-app Report or email [email protected].
Provide context, screenshots, and URLs.
We act proportionally and may escalate repeated or severe violations.

ANNEX B — SAFETY TIPS FOR IN-PERSON SWAPS
Meet in public, well-lit locations. Consider partner cafés or police-station safe zones where available.
Share details of the meeting with a trusted person.
Inspect items carefully before agreeing.
If anything feels unsafe, leave immediately and report the user in-app.
